SIU finds no wrongdoing by Hamilton Police officer who fatally shot double homicide suspect

The Special Investigations Unit (SIU) conducted an investigation into a Hamilton police officer who shot a 57-year-old man in Hamilton and concluded that he did not break the law.

The incident occurred on May 27, when the man, Terry Brekka, shot and killed two of his tenants before being shot by an officer at a residence on Jones Road.

Police responded to a distress call at the residence and upon arrival, they encountered a highly volatile situation where the suspect had already taken the lives of his two tenants.

The landlord then barricaded himself in the residence with firearms that were registered to him, according to police.

Although police said they tried to peacefully negotiate with the landlord, he was killed after an exchange of gunfire with an officer at about 10 p.m.

The SIU’s mandate is to investigate incidents involving police where there has been death, serious injury, or allegations of sexual assault.

In this case, Director Joseph Martino found no reasonable grounds to believe the officer committed a criminal offence in connection with the shooting and closed the case.
