Attempted murder charged filed after Tim Hortons assault in Hamilton

Hamilton police seize gun at festival, search for suspects in assault and shootings

An attack outside a Hamilton Tim Hortons has resulted in the filing of an attempted murder charge.

A man and his son went to the Timmys at 1242 Highway 8 in Stoney Creek on Aug. 24. The pair confronted a group of men who were loudly playing music in the lot which was disturbing neighbouring houses.

During the confrontation, Hamilton Police say, the group of men grew aggressive and a physical fight ensued. The first man was struck in the head with a baseball bat leading to serious injuries.

Nearly five weeks later, one of the men was formally charged regarding the attack. On Sept. 20, police charged Nicolas Cappella, 20 of Grimsby, with;

  • attempted murder,
  • assault with a weapon, and
  • two counts of uttering death threats

“This investigation is ongoing and police are appealing to the public for information leading to the arrest of other individuals involved in this incident,” police said.
